** Electronics include relays, thermostats, temperature sensors, timers, time clocks, circuit breakers, switches, printed circuit boards, wiring harnesses, connectors, and other electrical control components manufactured by or supplied by USSM. Factory-installed compressor capacitors are considered part of the Compressor and are covered under the Compressor warranty.

Components manufactured by others but supplied by USSM as part of a USSM product or system are covered under the applicable component category stated above, unless otherwise stated in writing by USSM. Components not supplied by USSM are not covered under this Limited Product Warranty.

Lifetime Warranty for Stainless Steel Diffusers

Stainless Steel Diffusers supplied by USSM are warranted for the lifetime of the original Purchaser’s ownership of the diffuser. This Lifetime warranty is not transferable.

Subject to the conditions, exclusions, limitations, and claim procedures stated in this Limited Product Warranty, the Lifetime warranty applies to the complete stainless steel diffuser assembly and its supplied diffuser components. USSM may require return of any diffuser, component, part, tubing, fitting, hardware, or related item claimed to have failed before approving warranty coverage.

The Lifetime warranty does not cover failure, damage, or deterioration caused by physical damage, impact, crushing, improper handling, improper installation, unauthorized alteration, misuse, abuse, freezing, chemical exposure, animal damage, vandalism, loss, theft, environmental conditions beyond USSM’s control, or any other external cause beyond the reasonable control of USSM.

This Warranty Summary is provided for convenience only. The provisions contained within this Limited Product Warranty shall govern all warranty coverage.

For the purposes of this Limited Warranty, “Purchaser” means the original end-user/purchaser of the covered product from USSM or an authorized USSM dealer/distributor. The warranty period begins on the date the original end-user /purchaser purchased the product, provided proof of purchase is available; otherwise, USSM may determine the start date from manufacturing, shipment, dealer sale, or other records.

Products purchased from unauthorized sellers, liquidation channels, salvage sellers, auction sites, or other sources not approved by USSM may be ineligible for warranty coverage unless USSM can verify product identity, original sale, condition, and chain of custody.

1. SCOPE

For the purposes of this Limited Product Warranty, US Solar Mounts Corp may be referred to as “USSM”.

This Limited Product Warranty applies to all products, assemblies, and components manufactured by or supplied by US Solar Mounts Corp (“USSM”), including products or components manufactured by others but supplied by USSM as part of a USSM product or system, unless a product is expressly excluded from this Limited Product Warranty or is covered by a separate written warranty issued by USSM.

For covered products purchased on or after the Effective Date, this Limited Product Warranty supersedes all prior warranty statements, product-specific warranty certificates, website warranty descriptions, advertisements, brochures, sales literature, dealer representations, verbal statements, installation guides, owner’s manuals, or other publications issued by USSM concerning warranty coverage. In the event of any conflict, this Limited Product Warranty shall govern unless expressly modified in writing by an authorized officer of USSM.

Products purchased before the Effective Date remain subject to the warranty terms in effect at the time of original purchase unless USSM expressly agrees otherwise in writing.

This Limited Product Warranty is extended only to the original purchaser/end user and is not transferable.

The Purchaser is encouraged to read this Limited Product Warranty in its entirety before submitting a Warranty Claim.

2. WARRANTY COVERAGE

USSM warrants covered products, assemblies, and components manufactured by or supplied by USSM to be covered during the applicable warranty period as stated in the Warranty Summary and as further described in this Limited Product Warranty, subject to the terms, conditions, exclusions, and limitations stated herein.

Should a covered defect or covered failure occur during the applicable warranty period, USSM shall, at its sole option:

  • Repair the affected component, product, or assembly; or
  • Replace the affected component, product, or assembly with a new, repaired, remanufactured, refurbished, or factory-refurbished component, product, or assembly.

Repair or replacement under this Limited Product Warranty constitutes the Purchaser's sole and exclusive remedy.

USSM shall determine whether a reported condition constitutes a covered defect, covered failure, or other condition covered by this Limited Product Warranty.

Components repaired or replaced under this Limited Product Warranty shall remain subject to the original warranty period applicable to the original product and shall not establish a new warranty period.

Products, equipment, materials, or components supplied by the Purchaser, owner, installer, dealer, contractor, or any third party other than USSM are not covered under this Limited Product Warranty.

The applicable warranty period shall commence on the original date of purchase.

3. CONDITIONS PRECEDENT TO WARRANTY COVERAGE

Warranty coverage is expressly conditioned upon compliance with each of the following requirements. Failure to satisfy any applicable requirement constitutes grounds for denial of warranty coverage.

3.1 Warranty Registration

Warranty registration must be completed within thirty (30) days of original purchase. Failure to complete registration may delay warranty service and may constitute grounds for denial of coverage if USSM is unable to verify purchase date, product identity, installation information, or other information necessary to evaluate the claim.

Warranty Registration shall include all information requested by USSM applicable to the product. Submission of incomplete, inaccurate, misleading, or intentionally false information constitutes grounds for denial of any Warranty Claim.

3.2 Product Identification

Warranty coverage applies only to products that can be positively identified by model number, serial number, manufacturing records, or other means acceptable to USSM. Removal, alteration, or illegibility of serial number labels constitutes grounds for denial of warranty coverage.

3.3 Installation

Products shall be installed, operated, maintained, serviced, stored, and used in accordance with all applicable USSM Installation Manuals, Owner’s Manuals, published specifications, product labels, written instructions, and applicable codes, as well as any applicable manufacturer operation, maintenance, installation, or service instructions for components supplied by USSM.

3.4 Inspection

USSM shall be afforded the opportunity to inspect the product, assembly, component, and, when applicable, the complete product or system in its entirety, as installed, as-is, and in-place, before repair, alteration, modification, removal, relocation, disposal, replacement, or other action that may affect USSM’s ability to evaluate the Warranty Claim.

USSM may waive this inspection requirement in writing. If USSM does not waive this requirement and is denied a commercially reasonable opportunity to inspect the product, assembly, component, or complete system as installed, as-is, and in-place, warranty coverage may be denied.

The Purchaser shall preserve the product, assembly, component, installation condition, failed parts, related components, and relevant evidence until USSM has completed its warranty evaluation or has expressly released the items in writing.

3.5 Ownership

This Limited Product Warranty applies only to the original Purchaser. Proof of purchase shall be provided upon request by USSM.

4. ELECTRICAL REQUIREMENTS

Because Compressors, Cooling Fans, and Electronics are dependent upon proper electrical service for safe and reliable operation, warranty coverage applicable to such components is expressly conditioned upon compliance with the following requirements.

4.1 Permanent Electrical Installation

Products requiring utility power shall be connected only to a permanent electrical installation conforming to all applicable electrical codes and USSM installation requirements.

4.2 Extension Cords

Operation of any USSM product by means of any extension cord, regardless of conductor size, conductor length, voltage rating, or intended duty, constitutes misuse and shall void warranty coverage applicable to Compressors, Cooling Fans, and Electronics.

4.3 Supply Voltage

Products shall be operated only within the electrical specifications published by USSM. Damage resulting from undervoltage, overvoltage, excessive voltage drop, phase imbalance, improper frequency, improper grounding, improper overcurrent protection, improper conductor sizing, loose electrical connections, or other improper electrical service is expressly excluded from warranty coverage.

USSM may require voltage measurements, current measurements, conductor information, or other electrical data before approving any Warranty Claim involving electrical components.

Electrical measurements submitted in support of a Warranty Claim shall be obtained with the product operating under normal load unless otherwise requested by USSM.

5. TEMPERATURE INDICATOR

Products equipped with a factory-installed temperature indicator shall retain such indicator in its original location and condition.

Removal, alteration, obstruction, damage, replacement, or unreadability of the temperature indicator may constitute grounds for denial of warranty coverage where it prevents USSM from evaluating enclosure temperature, overheating, misuse, or operating conditions.

Any Warranty Claim involving Compressors, Cooling Fans, or Electronics contained within an enclosure equipped with a factory-installed temperature indicator must include a clear photograph of the temperature indicator in its installed location. Failure to provide the required photograph constitutes grounds for denial of the Warranty Claim unless expressly waived in writing by USSM.

Only USSM may remove, replace, relocate, alter, or otherwise disturb a factory-installed temperature indicator. Replacement, removal, alteration, obstruction, or disturbance by any dealer, installer, service provider, customer/end user, or third party shall void warranty coverage applicable to Compressors, Cooling Fans, and Electronics contained within that enclosure.

6. WARRANTY CLAIM PROCEDURE

6.1 Warranty Claims

Warranty Claims shall be submitted within fifteen (15) days after discovery of the alleged defect using the current online Warranty Claim Form provided by USSM. The Warranty Claim Form may be made available through USSM’s website, customer service department, or other electronic method designated by USSM.

A Warranty Claim shall not be deemed received until the completed Warranty Claim Form and all required information requested by USSM have been submitted. Submission of a Warranty Claim does not constitute acceptance of warranty coverage.

6.2 Return Material Authorization

Products or components shall not be returned to USSM without a valid Return Material Authorization (RMA) issued by USSM. Requests for return authorization shall be submitted using the current online RMA Request Form provided by USSM, unless USSM expressly authorizes another method in writing.

Products received without an authorized RMA may be refused, returned to the sender at the sender’s expense, or held pending receipt of the required information.

6.3 Warranty Evaluation

USSM shall determine the information, documentation, testing, inspection, and returned components necessary to evaluate a Warranty Claim.

USSM shall determine warranty eligibility in the first instance based on its reasonable evaluation of the product, available evidence, and applicable warranty terms.

Such descriptions, opinions, or diagnoses may be considered by USSM but shall not be binding on USSM and shall not, by themselves, establish warranty eligibility or component failure.

No Warranty Claim shall be approved unless approved in writing or by electronic confirmation issued by an authorized representative of USSM.

6.4 Requested Information

USSM may require photographs, electrical measurements, installation information, troubleshooting procedures, operating data, proof of purchase, or other information necessary to evaluate a Warranty Claim.

Failure to provide requested information constitutes grounds for denial of the Warranty Claim.

6.5 Preservation and Return of Components

USSM shall determine which products, assemblies, components, diffusers, failed parts, related components, tubing, fittings, hardware, photographs, measurements, service records, or other evidence must be preserved or returned for evaluation. USSM may also require return of additional components, assemblies, or the complete product whenever necessary to determine the cause of the reported failure.

Failure to preserve or return requested items constitutes grounds for denial of the Warranty Claim.

Components that have been disassembled, altered, modified, repaired, discarded, replaced, or otherwise compromised prior to evaluation shall be ineligible for warranty coverage unless such action was expressly authorized by USSM.

Returned warranty components shall become the property of USSM unless otherwise agreed in writing.

6.6 Remote Troubleshooting

USSM may require troubleshooting by telephone, electronic communications, photographs, video conference, or other reasonable means before authorizing return of any product or component.

The Purchaser shall cooperate with requested troubleshooting procedures.

6.7 Service Records

USSM may require service records, photographs, videos, diagnostic measurements, technician notes, part numbers, serial numbers, proof of part source, installation dates, repair dates, and identification of any person or entity performing troubleshooting, service, repair, or part replacement.

Failure to provide requested service records or documentation constitutes grounds for denial of the Warranty Claim if the missing information prevents USSM from evaluating the claim, determining the cause of failure, confirming use of approved parts, or confirming compliance with authorized service procedures.

6.8 No Fault Found

If USSM determines that a returned product or component is functioning properly, or that the reported failure resulted from conditions not covered under this Limited Product Warranty, the Warranty Claim shall be denied, and the product or component may be returned to the Purchaser. Purchaser is responsible for return shipping costs.

6.9 Advance Replacement

Shipment of replacement products or components prior to completion of warranty evaluation shall not constitute an admission of warranty coverage or liability by USSM.

6.10 Condition of Returned Products

Products returned for evaluation shall be reasonably clean and free of hazardous substances or biological contamination. USSM reserves the right to refuse inspection of products received in an unsafe condition.

Purchaser shall be responsible for adequate packaging of returned products.

7. SOFTWARE, FIRMWARE, CONNECTIVITY, AND ELECTRONIC CONFIGURATION

Products containing software, firmware, embedded programming, wireless communication features, web-based interfaces, mobile-device interfaces, time clocks, timers, real-time clocks, control logic, programmable settings, or electronic configuration features are subject to the additional limitations stated in this Section.

USSM does not warrant that any software, firmware, embedded programming, wireless communication feature, web-based interface, mobile-device interface, browser interface, network connection, remote-access feature, Wi-Fi connection, Bluetooth connection, cellular connection, internet connection, or related electronic function will be uninterrupted, error-free, continuously available, compatible with all devices, compatible with all operating systems, compatible with all browsers, compatible with all routers or network equipment, or compatible with future third-party hardware, software, firmware, applications, networks, security protocols, or communication standards.

Warranty coverage does not include failure, malfunction, loss of function, loss of communication, loss of connectivity, configuration difficulty, programming error, user-interface issue, remote-access issue, time-sync issue, clock-setting issue, notification issue, network-discovery issue, login issue, password issue, credential issue, or data-access issue caused by or resulting from any of the following:

  • customer-owned, owner-owned, installer-owned, dealer-owned, or third-party phones, tablets, computers, routers, modems, access points, repeaters, network equipment, cables, software, applications, browsers, operating systems, security settings, firewalls, VPNs, internet service, cellular service, Wi-Fi signal conditions, Bluetooth signal conditions, network configuration, or other external equipment or services;
  • weak, intermittent, blocked, congested, unstable, incompatible, or unavailable Wi-Fi, Bluetooth, cellular, internet, or network service;
  • changes, updates, restrictions, incompatibilities, discontinuation, or failures involving third-party devices, operating systems, browsers, applications, routers, networks, internet service providers, cellular providers, security certificates, communication protocols, or cloud-based services;
  • improper setup, improper programming, improper configuration, incorrect time or date settings, incorrect mode selection, incorrect schedule programming, failure to complete required setup steps, failure to follow USSM instructions, or unauthorized changes to settings, software, firmware, hardware, wiring, or configuration;
  • loss of power, interruption of power, improper electrical service, electrical noise, voltage fluctuation, surge, lightning, electrostatic discharge, utility disturbance, generator or inverter irregularity, brownout, improper grounding, or other external electrical condition;
  • unauthorized software, firmware, hardware, network, or configuration modification;
  • attempted repair, reprogramming, re-flashing, reverse engineering, circumvention, security bypass, unauthorized access, tampering, or alteration;
  • malware, viruses, cyberattack, unauthorized access, credential compromise, denial-of-service activity, network intrusion, third-party platform failure, or other cybersecurity event not caused by a defect in material or workmanship in a USSM-supplied product.

Software or firmware updates, revisions, patches, configuration changes, feature changes, compatibility changes, or other modifications may be issued by USSM from time to time at USSM’s sole discretion. USSM is not obligated to provide any particular software update, firmware update, feature update, compatibility update, security update, continued remote-access function, continued third-party compatibility, or continued support for any third-party device, operating system, browser, application, network, protocol, or service.

Installation of software or firmware updates may be required before USSM approves or continues evaluation of a Warranty Claim involving electronics, controls, communication functions, programming, timing, scheduling, remote access, or related functions. Failure to install or permit installation of required software or firmware updates may constitute grounds for denial of a Warranty Claim if such failure prevents USSM from evaluating the claim, confirming product operation, correcting the reported condition, or determining the cause of the reported condition.

Data, settings, schedules, logs, passwords, credentials, configuration files, wireless settings, time-clock settings, event history, and other electronic information may be reset, modified, erased, overwritten, or lost during troubleshooting, service, repair, replacement, firmware update, software update, factory reset, or warranty evaluation. USSM shall not be liable for loss, deletion, corruption, modification, or unavailability of any such data, settings, schedules, logs, credentials, configuration, or electronic information.

Warranty coverage for software, firmware, embedded programming, controls, communication features, and electronic configuration is limited to defects in material or workmanship in the USSM-supplied product that prevent the product from performing its intended control function under normal operating conditions and within published USSM specifications. This Limited Product Warranty does not cover customer training, programming assistance, network setup, router configuration, device pairing, browser configuration, operating-system compatibility, internet service, cellular service, Wi-Fi service, Bluetooth service, remote-access availability, or other third-party equipment, service, or compatibility issues.

8. WARRANTY EXCLUSIONS

Except as otherwise expressly stated in this Limited Product Warranty, warranty coverage applies only to covered defects or covered failures occurring during the applicable warranty period. Warranty coverage is expressly excluded for failures or damage resulting, in whole or in part, from any of the following:

8.1 Wear Items

Normal wear, routine maintenance, or replacement of Wear Items, including, but not limited to, air filters, rebuild kits, piston cups, reed valves, bearings, seals, gaskets, lubricants, and similar maintenance items.

8.2 Improper Installation or Operation

Improper installation, operation, maintenance, storage, servicing, transportation, relocation, misuse, abuse, negligence, accident, vandalism, or operation contrary to any applicable USSM Installation Manual, Owner’s Manual, published specification, product label, written instruction, applicable code, or applicable manufacturer operation, maintenance, installation, or service instruction for components supplied by USSM.

8.3 Improper Electrical Service

Improper electrical service including, but not limited to:

  • improper voltage
  • excessive voltage drop
  • undersized conductors
  • improper grounding
  • improper overcurrent protection
  • improper frequency
  • loose electrical connections
  • improper generator or inverter power
  • operation by means of any extension cord

8.4 Unauthorized Alteration, Repair, or Disassembly

Repair, alteration, modification, disassembly, substitution of components, installation of non-approved parts, removal or alteration of serial number labels, or any modification not expressly authorized by USSM is excluded from warranty coverage.

Service, repair, troubleshooting, or replacement of parts performed by a USSM-authorized dealer, installer, service provider, or customer/end user shall not void warranty coverage solely because such work was performed by that party, provided the work was performed within the scope of general or claim-specific authorization granted by USSM and in accordance with all applicable USSM instructions, manufacturer instructions, and approved service procedures.

Warranty coverage is preserved only when replacement components are supplied by USSM or expressly approved in writing by USSM. Use of substitute, aftermarket, locally sourced, customer-supplied, installer-supplied, dealer-supplied, or otherwise non-approved replacement components constitutes unauthorized repair and is excluded from warranty coverage.

Removal, replacement, relocation, alteration, obstruction, damage, or disturbance of any factory-installed Temperature Indicator is governed by Section 5 and is excluded from warranty coverage except when performed by USSM.

8.5 External Causes

Lightning, utility power disturbances, utility service interruptions, power outages, fire, flood, freezing, hail, severe weather, Acts of God, corrosion, chemical exposure, insect infestation, rodent damage, animal damage, or other causes beyond the reasonable control of USSM, except to the limited extent expressly covered elsewhere in this Limited Product Warranty.

8.6 Overheating

Failure of Compressors, Cooling Fans, or Electronics resulting from inadequate enclosure ventilation, excessive enclosure temperature, blocked airflow, activation of the factory-installed Temperature Indicator, or operation beyond the thermal design limits of the product.

8.7 Cosmetic Conditions and Powder-Coated Finish

Except for qualifying powder-coated finish failure expressly covered below, scratches, dents, fading, discoloration, chalking, staining, surface corrosion, finish deterioration, or other cosmetic conditions that do not impair normal product operation are excluded from warranty coverage.

Powder-coated finish is covered for one (1) year from the original date of purchase, but only for true coating failure resulting from defective coating material or defective application on components supplied by USSM. Covered coating failure is limited to peeling, flaking, blistering, or loss of adhesion that USSM determines was caused by a defect in material or workmanship.

Powder-coated finish coverage does not include scratches, chips, dents, fading, discoloration, chalking, staining, abrasion, impact damage, corrosion, chemical exposure, fertilizer exposure, salt exposure, pond chemicals, improper cleaning, environmental exposure, shipping damage, animal damage, normal weathering, or finish deterioration resulting from use, handling, installation, maintenance, storage, or site conditions.

Finishes applied by third-party vendors, installers, owners, dealers, contractors, or any party other than USSM are not covered under this Limited Product Warranty.

8.8 Third-Party-Manufactured and Non-USSM-Supplied Components

Components manufactured by others but supplied by USSM as part of a USSM product or system are covered only under the applicable component category stated in the Warranty Summary, unless otherwise stated in writing by USSM.

Products, equipment, materials, or components not supplied by USSM, including customer-supplied, owner-supplied, installer-supplied, dealer-substituted, or aftermarket components, are not covered under this Limited Product Warranty. To the extent assignable, USSM may pass through any manufacturer’s warranty applicable to such items. USSM assumes no obligation beyond the warranty, if any, provided by the original manufacturer.

8.9 Shipping Damage

Damage occurring after delivery to the Purchaser or resulting from improper packaging or shipment to or from USSM.

8.10 Repeated Failures

Repeated failure of the same or similar component shall not, by itself, establish a defect in materials or workmanship.

Warranty coverage does not extend to repeated failures resulting from installation deficiencies, improper electrical service, operating conditions, environmental conditions, misuse, abuse, or other external causes that remain uncorrected after notification by USSM.

8.11 Unauthorized Replacement Components

Failures, damage, operational problems, or related component failures resulting from or affected by the installation or use of replacement components not supplied by USSM or expressly approved in writing by USSM are excluded from warranty coverage.

Warranty coverage may be denied for any component that has been replaced, altered, repaired, modified, or affected by use of a non-approved replacement component.

8.12 Failure to Cooperate

Failure to provide requested documentation, photographs, electrical measurements, inspection access, requested components, service records, or other information necessary for evaluation of a Warranty Claim constitutes grounds for denial of the Warranty Claim.

9. LIMITATION OF LIABILITY

9.1 Replacement Components

USSM may satisfy its obligations under this Limited Product Warranty through the use of new, repaired, remanufactured, refurbished, or factory-refurbished products or components.

Products or components repaired or replaced under this Limited Product Warranty shall remain subject to the original warranty period applicable to the original product and shall not establish a new warranty period.

9.2 Costs Not Covered

Except for repair or replacement performed directly by USSM as the remedy approved under this Limited Product Warranty, this Limited Product Warranty does not cover labor, diagnosis, troubleshooting, removal, reinstallation, transportation, freight, shipping, rental equipment, cranes, excavation, electrical work, plumbing, contractor charges, permitting, travel expenses, or any other costs associated with installation, removal, repair, replacement, or return of any product or component unless expressly authorized in writing by USSM.

9.3 Limitation of Liability

USSM shall not be liable for injury to persons, animals, fish, livestock, structures, real property, personal property, crops, vegetation, business operations, income, profits, goodwill, reputation, or any direct, indirect, incidental, consequential, exemplary, punitive, or special damages arising from the use of, inability to use, or failure of any product covered by this Limited Product Warranty, regardless of the legal theory asserted, including contract, negligence, strict liability, warranty, or otherwise, even if USSM has been advised of the possibility of such damages.

9.4 Maximum Liability

Under no circumstances shall the total liability of USSM exceed the original purchase price paid by the Purchaser for the affected product, assembly, system, or component supplied by USSM that gives rise to the Warranty Claim. USSM shall determine the affected product, assembly, system, or component based on the Warranty Claim and USSM’s evaluation.

Repair or replacement as provided under this Limited Product Warranty constitutes the Purchaser's sole and exclusive remedy.

9.5 No Implied Warranties

USSM MAKES NO IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

Where implied warranties cannot be lawfully disclaimed, such warranties are limited to the shortest period permitted by applicable law.

9.6 Environmental Losses

USSM shall not be liable for fish mortality, loss of aquatic life, aquatic vegetation loss, water quality degradation, algae growth, ecosystem changes, or other environmental or biological damages arising from product failure, improper installation, improper operation, interruption of electrical service, loss or interruption of air delivery, or conditions beyond the control of USSM.

10. GENERAL PROVISIONS

10.1 Entire Agreement

For products purchased on or after the Effective Date, this Limited Product Warranty constitutes the entire warranty provided by USSM and supersedes all prior warranty statements, representations, understandings, communications, whether written or oral, relating to the products covered hereby.

10.2 No Authority to Modify Warranty

No dealer, distributor, installer, contractor, salesperson, representative, employee, or other person is authorized to modify, enlarge, extend, waive, or alter any provision of this Limited Product Warranty except by written or electronic instrument executed or expressly approved by an authorized officer of USSM.

Statements, recommendations, representations, or advice provided by dealers, distributors, installers, contractors, or other third parties that are inconsistent with published USSM documentation shall not modify this Limited Product Warranty.

10.3 Dealers, Installers, Contractors, Service Providers, and Authorized Work

Dealers, distributors, contractors, installers, service providers, customers/end users, and other third parties are not employees, agents, or legal representatives of USSM and have no authority to modify, enlarge, extend, waive, or alter this Limited Product Warranty; approve Warranty Claims; admit liability on behalf of USSM; or bind USSM to any obligation unless expressly authorized in writing by USSM.

Installation, repair, service, troubleshooting, or replacement of parts performed by dealers, distributors, contractors, installers, service providers, customers/end users, or other third parties shall not be construed as acts of USSM unless performed by a USSM employee or unless USSM expressly agrees in writing to assume responsibility for the specific work performed.

USSM may authorize dealers, installers, service providers, or customers/end users to perform troubleshooting, service, repair, or replacement of parts on a general or claim-specific basis. Such authorization preserves warranty eligibility only to the extent the work is performed within the scope of authorization, using parts supplied by USSM or expressly approved in writing by USSM, and in accordance with applicable USSM instructions, manufacturer instructions, and approved service procedures.

Damage, failure, or additional repair required as a result of improper installation, improper service, improper repair, improper diagnosis, improper replacement, use of non-approved parts, or failure to follow applicable instructions by any dealer, installer, contractor, service provider, customer/end user, or other third party is excluded from warranty coverage.

10.4 Governing Law

This Limited Product Warranty shall be governed by and construed in accordance with the laws of the State of Wisconsin.

10.5 Venue

Any legal action arising out of or relating to this Limited Product Warranty shall be brought exclusively in a court of competent jurisdiction located in Monroe County, Wisconsin.

10.6 Severability

If any provision of this Limited Product Warranty is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10.7 Waiver

Failure of USSM to enforce any provision of this Limited Product Warranty shall not constitute a waiver of that provision or any other provision of this Limited Product Warranty.

10.8 Headings

Section headings are provided for convenience only and shall not affect interpretation of this Limited Product Warranty.

This Limited Product Warranty gives the Purchaser specific legal rights. The Purchaser may also have other rights that vary by state or jurisdiction. Some states or jurisdictions do not allow limitations on implied warranties or the exclusion or limitation of incidental or consequential damages, so certain limitations or exclusions stated in this Limited Product Warranty may not apply to the Purchaser.
